1. Scope
These Terms and Conditions apply to all contracts for digital products and digital services provided by UnleashWP | Benjamin Zekavica, in particular e-books, digital downloads, software, licenses, digital access (e.g., membership area) as well as memberships/subscriptions.
Any deviating terms of the customer shall not apply unless we expressly agree to their validity in writing.
2. Services / Subject matter of the contract
We offer digital content and products, in particular:
- E-books and digital publications
- Software, plugins, scripts, tools, licenses
- Digital downloads (e.g., templates, files, assets)
- Digital access (e.g., membership area, libraries, on-demand content)
- Memberships/subscriptions with recurring billing
The specific scope of services results from the respective product description, the checkout and, where applicable, the membership area.
3. Conclusion of contract (Digistore24)
Purchase and billing are processed via the Digistore24 checkout. The information provided in the checkout (product description, price, payment method) is decisive.
The contract is concluded as soon as the order process in the checkout has been completed and you receive a confirmation.
4. Prices, payment and billing
The prices shown in the Digistore24 checkout apply. Payment processing is handled by Digistore24 using the payment methods offered there.
For memberships/subscriptions, billing is carried out monthly for the respective month of use (billing period). The billing period and start date result from the checkout and/or order confirmation.
5. Provision, access and availability
Digital content is provided immediately after payment, depending on the product (e.g., download link, access to the membership area, license access). You are responsible for ensuring that the necessary technical requirements (internet connection, browser, PDF reader, etc.) are available.
6. Rights of use
All content (e.g., e-books, templates, texts, videos, code, designs, software) is protected by copyright. Unless expressly agreed otherwise, you receive a non-exclusive, non-transferable right to use the content for your own purposes. Any forwarding, reproduction, publication or making available to the public (even in part) is prohibited without written consent.
7. Memberships / subscriptions (monthly cancellable)
(a) Term: Memberships can be cancelled monthly.
(b) Billing: Billing is carried out for the respective month of use. Only the month in which the membership is active will be charged.
(c) End after cancellation: After effective cancellation, the membership ends at the end of the already paid month of use. After that, no further charges apply and access to membership content ends.
8. 60-day refund policy (voluntary refund promise)
For many of our digital products, we offer—additional to your statutory rights—a voluntary 60-day refund policy from the date of purchase (“60-day guarantee”).
How it works: Send an email within 60 days to support@unleash-wp.com including (1) your order email/proof of purchase (Digistore24), (2) the product name, and (3) a short request for a refund.
Processing: If the requirements are met, the refund will be initiated via Digistore24 to the original payment method.
Exceptions / abuse: The voluntary refund policy does not apply in cases of abuse (e.g., sharing/publishing content, repeated refunds of similar products within a short period, or demonstrably improper behavior). Statutory rights remain unaffected.
9. Right of withdrawal (consumers only)
If you are a consumer, you generally have a statutory right of withdrawal. Details are provided in the withdrawal information during the ordering process.
Note on digital content: For digital content, the right of withdrawal may expire prematurely if you expressly agree that we begin performance before the withdrawal period ends and you confirm your knowledge that you thereby lose your right of withdrawal. This is typically requested during checkout.
Important: Regardless of this, our voluntary 60-day refund policy under section 8 may grant you additional rights.
10. Updates, changes and availability of software/downloads
For software, templates and digital downloads, updates, changes or adjustments may be required (e.g., for security reasons or compatibility). A claim to specific versions or permanent compatibility with third-party software exists only if expressly guaranteed in the product description.
11. Liability
We are liable without limitation for intent and gross negligence as well as for injury to life, body or health. In cases of slight negligence, we are liable only for breach of essential contractual obligations (cardinal obligations) and limited to the typically foreseeable damage. Liability for lost profits, data loss or indirect damages is excluded to the extent permitted by law.
12. Final provisions
German law applies. The contract language is German.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall apply in place of the invalid provision.
